CRIMINAL CASE MANAGEMENT 

Section 551.1 (1) of the Criminal Code allows the Chief Justice or the Chief Justice's designate judge to appoint a Case Management Judge if they are of the opinion that it is necessary for the proper administration of justice. The Chief Justice or the Chief Justice's designate judge may order a conference between the prosecutor and the accused or counsel for the accused, or a hearing be held for the purpose of deciding if the appointment will be made.

A party seeking the appointment of a Case Management Judge should provide to the Chief Justice or the Chief Justice's designate judge the following:

  • the names of all counsel;
  • a copy of the indictment;
  • a list of proposed voir dire and trial witnesses;
  • a list of all pre-trial applications and voir dires that are proposed to be heard by a Case Management Judge before trial, as well as the anticipated duration and proposed dates for each;
  • reasons why the appointment of a Case Management Judge is necessary for the proper administration of justice and, additionally
  • any reason(s) why the Case Management Judge should not be the Trial Judge.

Requests for the appointment of a case management judge in a criminal matter will be handled by the Chief Justice, except for the following:

  • Criminal case management assignment responsibilities in Calgary and Drumheller will be handled by Justice David Labrenz, who is designated to appoint case management justices under s.551.1 of the Criminal Code.
  • Criminal case management assignment responsibilities in Red Deer will handled by Justice Marilyn Slawinsky insofar as they relate to the assignment of local resident justices. If such assignment requires a non-resident justice, the case management application shall be directed to the Chief Justice.
  • Criminal case management assignment responsibilities in Lethbridge and Medicine Hat will be handled by Justice Johnna Kubik insofar as they relate to the assignment of local resident justices. If such assignment requires a non-resident justice, the case management application shall be directed to the Associate Chief Justice;
